Definitions

"The developer" means the Tb‑Scout v3.3 developer, i.e. OE Ospina-Cuervo aka Ozzie O (a world citizen, journalist, technical writer, polyglot translator and linguist who also speaks computerese and IT). "The developer" and "we" are terms used interchangeably. "The user" means you, the person using the software. "The software" means Tb‑Scout v3.3, The MultiTerm™* Explorer and The Translations Memory Explorer. "The software" and "the application" are terms used interchangeably.

By accessing or using the software you agree to be bound by these Terms and Conditions. Do not install or use the software until you have read and accepted these Terms and Conditions.

Privacy Notice

User privacy is important to the developer. Tb‑Scout v3.3 does not collect, or share with third parties, any type of information, including personally identifiable information, from the user. The only information collected is the user’s email address and only if and when the user decides to purchase a product license.

When the application is in use, it is never connected or directed to any server. The application runs exclusively in the user’s computer, completely disconnected from the outside world. During the registration process, Tb‑Scout v3.3 does not install anything on the user’s computer when the user agrees to the terms in the (current) License Agreement by pressing "Install". The only action performed is no other than to configure the stand-alone application file (with the extension .accde) to work in the user's computer.

In addition, the application does not include ads nor promotes any sort of upselling for licensed users. Privacy is guaranteed.

License grants and restrictions

The software is copyrighted, and it is licensed to you under this EULA, not sold to you. The developer grants the user a personal, limited, non-exclusive, non-transferable license. The software can be downloaded and used in "basic edition" mode, for a limited period of time as determined by the developer, and the user is under no obligation to buy anything.

A Product License Key must be purchased to unlock the full functionality of the software (i.e. beyond the "basic edition"), so that the user will be able to use the software in "licensed mode". The Product License Key, which provides the equivalent of a two-year subscription, is unique to the user’s PC and it cannot be used anywhere else, including in the same computer under another Windows user. You are required to send a screenshot of the About form together with your Pre-Order Key. If you wish you can conceal your computer name and Windows user name in the About form.

Once the Product License Key is registered within the application, information clearly labeled will be included (in the About box) on the number of license days remaining to use the software . The two-year or one-year subscriptions will start on the date on which the user unlocks the software, not on the date of installation, nor on the date when a Pre-Order Key was generated, nor on the date of purchase.

The differences between "basic edition" mode and "licensed edition" mode are summarized in the "Editions and Licenses" page of the User Guide, under the "Welcome to Tb-Scout v3.3" section.

Support

The software comes with complete documentation (Help System or User Guide) included in electronic format, specifically in the file named TbSv33.chm (which can be delivered to the user only upon request). The User Guide is also available in web format using the URL https://tbscout33.translationist.com/ug/. The context-sensitive help information of the CHM file can be reached anywhere from within the software by pressing F1 or by opening said file separately. At any time, you may contact the developer via email at tbsv33.user @ translationist.com for technical support with questions not answered in the User Guide. Replies will only be provided for those email messages that include screenshots and specific questions or comments, although a prompt reply is not guaranteed. Messages that do not include screenshots will be ignored.

Further development of the software in its present form and technology is not guaranteed either, and this current version 3.3 might be the last version released to the public. At any rate, technical support will always be provided as long as a Product License Key is in effect, in particular, and if there are enough interested users, in general.

Disclaimer of Liability

THE SOFTWARE AND DOCUMENTATION ARE LICENSED "AS IS," AND THE DEVELOPER DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT AUTHORIZED BY LAW. WITHOUT LIMITATION OF THE FOREGOING, THE DEVELOPER EXPRESSLY DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT THE SOFTWARE DOES NOT CONTAIN ANY VIRUSES. YOU ASSUME RESPONSIBILITY FOR SELECTING THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE RESULTS OBTAINED FROM YOUR USE OF THE SOFTWARE. YOU SHALL BEAR THE ENTIRE RISK AS TO THE QUALITY AND THE PERFORMANCE OF THE SOFTWARE.

The software in "licensed edition" mode is expected to perform as explained in the User Guide and/or in the tutorials or promotional videos available on the internet.

Furthermore, and to be more specific, the developer disclaims any express or implied warranty of fitness of the software for exploring MultiTerm™ Termbases, i.e. .sdltb files,  a) containing more or less 100,000 total terms per language pair —using basic and extended searches—, or b) containing more or less 30,000 terms per language pair and several Descriptive Fields, at all levels. In other words, functionality is not guaranteed for a corpus of more or less 100,000 terms per language pair for all kinds of searches that do not involve Descriptive Fields or dates, and for a corpus of more or less 30,000 terms per language pair for searches that involve Descriptive Fields and dates. These figures may vary depending on the Termbase structure regarding the number of languages, the number of Descriptive Fields and the number of terms.

In addition, the developer disclaims any express or implied warranty of fitness of the software for exploring Translation Memories (i.e. .sdltm files) containing more than 100,000 total Translation Units, even if the application is able to handle bigger Translation Memories, including those with more than half a million of Translation Units.

These claims, in light of the "Scope and limitations" of the application as explained in the corresponding section of the User Guide. The Developer shall not be liable for system failures arising from fortuitous or unforeseen causes, which are dependent on, or conditioned by, something else, like the Microsoft Windows operating system used and its updates or the lack thereof, Microsoft 365 (aka Office 365) version and its updates or the lack thereof, and amount of system memory, as well as the data being processed (i.e. when using huge Termbases or Translation Memories), as indicated above, or Termbases and/or Translations Memories that might be corrupt or unusable due to misconfiguration, tampering, etc.

Refund Policy

In principle, all sales must be final. There are no refunds. Please ensure you have read and understood the chapter on "Scope and limitations" of the software.

There will also be no refunds if the application fails to meet the user's needs due to a lack of understanding by the user of the application functions and capabilities, if the user's system has an unconventional or 'tweaked' configuration not consistent with a standard Microsoft Windows operating system, and whether the user may be using software whose keyboard shortcuts might interfere with the application, circumstances which may prevent the application from functioning properly. Likewise, there will be no refunds if it is proven that the application file has been tampered with, a verifiable fact, which will result in immediate and automatic termination of the Product License Key, subsequently disabling the application.

Ownership of the software

The developer retains the copyright, title, and ownership of the software and the written materials.

The developer reserves the right to update these Terms and Conditions at any time without notice to you. The most recent version of the Terms and Conditions can be reviewed at https://tbscout30.translationist.com/ug/Termsandconditions.html. THIS ONLINE VERSION ALWAYS SUPERSEDES OTHER PREVIOUS VERSIONS.
